Human Rights Legislation Amendment Bill 2017

The submission to the Senate Legal and Constitutional Affairs Committee in relation to the Human Rights Legislation Amendment Bill 2017 was prepared by the Law Council.

The Bill would amend section 18C of the Racial Discrimination Act 1975 (Cth) (RDA) and the complaints handling processes of the Australian Human Rights Commission under the Australian Human Rights Commission Act 1986 (Cth) (AHRC Act). 

In particular, it would redefine conduct prohibited by section 18C of the RDA. The conduct define to encompass the notion of racial vilification is proposed to be amended by removing the words 'offend, insult, humiliate' from paragraph 18C(1)(a) of the RDA and replacing them with 'harass'.
