2023 Workplace Reform Consultations
The Law Council of Australia provided a submission to the Department of Employment and Workplace Relations (Department) in relation to aspects of its 2023 Workplace Reform Consultations.
The attached submission provides the Law Council’s response to each of the four consultation papers released by the Department as part of this process.
The Law Council notes that the Department is consulting on 11 items in the industrial relations sphere which are presently being considered by the Australian Government for introduction later in 2023. As part of this process, the Department has released consultation papers on four of these items. The titles of the four consultation papers are as follows:
- Same job, Same Pay (Consultation Paper 1);
- Compliance and enforcement: Criminalising wage theft (Consultation Paper 2);
- ‘Employee-like’ forms of work and stronger protections for independent contractors (Consultation Paper 3); and
- Updating the Fair Work Act 2009 to provide stronger protections for workers against discrimination (Consultation Paper 4).
