Opening Statement to the Parliamentary Joint Committee on Intelligence and Security (Foreign Influence Transparency Scheme Bill 2017)

The Law Council largely welcomes the proposed government amendments to the Foreign Influence Transparency Scheme Bill 2017. 

They significantly focus the Bill’s operation on its stated aim of making the exercise of foreign influence of Australia’s political and government matters more transparent through a registration system.

In our view, the narrowing of the Bill’s application goes a considerable way of improving the proportionality of the regime and, the Constitutional validity, of the legislation because it ensures that the Bill is appropriate and adapted to serve the legitimate end of the legislation.
