‘It’s a matter of trust’ – A discussion of Carter Holt Harvey Woodproducts Australia Pty Ltd v The Commonwealth & Ors  HCA 20 (Amerind)
The High Court’s judgement in Amerind provides answers to some of the questions which the insolvency profession has long sought about the insolvency of corporate trustees, however, it also leaves some unanswered.
The seminar will include:
- an analysis of the High Court’s decision, by leading insolvency lawyer, Scott Butler of McCullough Robertson, including what insolvent trust related issues remain unresolved;
- a discussion by Amelia Wheatley of the Queensland Bar, one of the counsel for the Commissioner of Taxation in the recent Lane v Deputy Commissioner of Taxation decisions, of the extent to which the principles may be applicable to bankruptcy and some unresolved issues, some of which should be considered in Lane v DCT; and
- comments from Matt Byrnes of Grant Thornton, joint receiver and manager of Amerind Pty Ltd (receivers and managers appointed) (in liquidation), about practical issues concerning allocation of costs and expenses against assets encountered during the receivership.
