Introduction of New Commonwealth Offences

In recent years there has been a significant expansion in the areas covered by Commonwealth criminal law. The Law Council carefully monitors and provided commentary and input on the introduction of new Commonwealth offences, particularly where those offences involve an extension of criminal liability, the imposition of an evidential or legal burdens on the defendant or strict or absolute liability.

Examples of proposed new Commonwealth offences that the Law Council has commented upon include:

  • Criminal organisation offences;
  • Cartel conduct offences;
  • Identity theft offences; and
  • Child sex tourism offences
